Submitting a quote request; or
Submitting a booking request through any form submission templates on our website; or
Submitting a booking request through digital or in person means as aforementioned; or
Requesting a quote for services, and agreeing for a service to be carried out (irrespective of whether payment in full, or a deposit has been made).
This section is inclusive of all of the following terms of communication in respect to engaging our services:
By way of social media communication: Facebook, Instagram, or other social media platforms; or
By email and other forms of digital communication; or
By telephone and all other forms of telecommunication; or
In-person, verbally; or
All other forms of written communication (both digital and non-digital)
In entering into a service agreement with TJR Construction Adelaide for services, you agree to abide by all terms and conditions listed and to fulfil any obligation to pay for services rendered within the timeframes stipulated by any invoices or other agreements as arranged by TJR Construction Adelaide
Quoting For Services:
TJR Construction Adelaide utilises industry experience from trade professionals to assist in providing comprehensive quotes for services. In order to provide accurate quotes, TJR Construction Adelaide also relies on accurate information supplied by customers engaging with our service, to ensure that services are carried out to the expected standard. This includes information supplied by the following means:
Through our website software, payment and booking system; or
By way of social media communication: Facebook, Instagram, or other social media platforms; or
By email and other forms of digital communication; or
By telephone and all other forms of telecommunication; or
In-person, verbally; or
All other forms of written communication (both digital and non-digital)
TJR Construction Adelaide will provide users with plans for services that reflects information supplied by the user. You agree to ensure that all information supplied relative to the information requested for quoting by TJR Construction Adelaide is accurate and reflects your needs, and the type of services requested. In the event that information supplied by you, the user, is inaccurate, untruthful, or incorrect at any point during the course of your quote request, TJR Construction Adelaide will attempt to contact you to re-quote the service, prior to work being carried out.
To assist with ensuring that accurate information regarding your service can be supplied to TJR Construction Adelaide, a member from TJR Construction Adelaide may request to meet with you ahead of services being carried out. This consultation will seek to obtain as much information as possible relative to details necessary for the provision of professional construction services. From there, TJR Construction Adelaide’s team will generate the required plans to assist in construction commencing. Most initial consultations are free, and do not require payment. However, if the process of quoting or consultation requires a greater level of time, resourcing, or equipment, TJR Construction Adelaide will advise you ahead of this taking place, and provide a cost associated with the appointment, completion of documentation, etc.
In the event of TJR Construction Adelaide recognising the information supplied by you is inaccurate, untruthful, or incorrect, and not being able to contact you prior to services being undertaken, you agree to pay TJR Construction Adelaide for the cost associated to any services rendered, along with any additional charges for additional time, equipment, or other supplies and services that may be required due to inaccurate or untruthful information being supplied.
In the event of TJR Construction Adelaide recognising the information supplied by you is inaccurate, untruthful, or incorrect, and making contact with you, TJR Construction Adelaide will supply you with an updated quote in writing or verbally (by telephone or in person). If you choose to decline to accept the updated quote, you agree to pay that TJR Construction Adelaide may opt to undertake either of the following options:
Charge you for the cost of the original quote for service provision without services being rendered (in the event information has been grossly misrepresented); or
Undertake services originally requested, for a period deemed appropriate given the information supplied having been identified as untruthful or inaccurate.
You agree to pay any invoices associated with these options in full, within the timeframes dictated by any formal invoices or other means of payment agreed upon between you and TJR Construction Adelaide in writing or as stated verbally.
An invoice for a service carried out by TJR Construction Adelaide will be provided when requested, or where payment is yet to have been made. You agree to abide by the timeframes stipulated by the invoice and make payment in full as requested by TJR Construction Adelaide. You agree to be bound by the original timeframes stipulated in any first invoice provided to you by TJR Construction Adelaide, even in the event that there are subsequent invoices supplied where services have been re-quoted for the same appointment or booking.
Parking:
Our team may be required to park in paid street parking, or parking garages to undertake your service. Whilst every effort will be made to contact you ahead of time to ascertain parking availability on or near your property, we understand that you’re busy and may not always get back to us in time. Upon engaging with us and booking your service, you agree that you may be invoiced for any reasonable costs associated to parking fees whether incurred on the street or in private parking garages (in accordance with guidelines stipulated by the relevant insurance scheme).
Parking fees will not be charged if you provide our team with an appropriate parking solution that does not incur costs to our team.
Payment:
You agree to pay for any charges incurred as a result of engaging our services, as dictated by any direction provided by TJR Construction Adelaide. This includes invoices being sent to email addresses, physical addresses, conversations in person, or any form of digital or telecommunication.
In the event an invoice is not paid, TJR Construction Adelaide may continue to invoice you for fees associated with your payment being overdue. In the event that TJR Construction Adelaide does not receive payment for services agreed upon, TJR Construction Adelaide may refer you to an independent debt collection agency, or take civil legal action as deemed appropriate for the full cost of the debt, and any subsequent fees associated with debt collection, late or overdue invoice fees, solicitors, and civil court applications and processes.
TJR Construction Adelaide may require a client to pay for an invoice in part, or in full, prior to services being undertaken.
You agree that failure to make payment for services rendered or agreed upon may result in legal action being initiated by TJR Construction Adelaide.
Removal of Structures and Material Where Breaches Arise:
In the event that you fail to abide by the terms or conditions of any of agreements entered into by TJR Construction Adelaide and you, you agree and permit staff or delegated representatives of TJR Construction Adelaide to attend at any property where you have requested services be carried out for the purpose of removing material or demolishing any work undertaken for the purpose of recouping costs or material. The decision to remove structures completely is the sole decision of TJR Construction Adelaide, and may not be appropriate or required in all circumstances.
You agree that this permission cannot be withdrawn after agreeing to these terms, and further agree to permit access to any such structures or material stored on the property for the purpose of TJR Construction Adelaide recovering them. You further agree to pay for the remaining costs associated with any services agreed upon by you and TJR Construction Adelaide.
In the event that you or another party at the property hampers, hinders, damages property under the control of TJR Construction Adelaide, or prevents TJR Construction Adelaide in recovering such material, TJR Construction Adelaide may take reasonable steps to enter onto the property to carry out their obligations under this section. You understand that any action in preventing TJR Construction Adelaide in carrying out these duties may result in damage being sustained to your property, and agree that any such damages arising are not the responsibility of TJR Construction Adelaide to remedy, and agree to hold harmless TJR Construction Adelaide.
You agree to notify all people present at the property of this condition ahead of time, and ensure that they do not hamper or prevent representatives from TJR Construction Adelaide in carrying out their duties in accordance with this agreement.
TJR Construction Adelaide will endeavour to provide notice of any such attendances taking place, and will exercise reasonable care in identifying themselves to occupants prior to entering, and further ensure that any damage arising from such attendances where you fail to permit access are limited.
TJR Construction Adelaide may contact police or emergency services in the event you assault or commit any offences against our representatives whilst present or attending at the property.
Collection of Unpaid Debts:
TJR Construction Adelaide reserves the right to engage independent debt collection agencies; and to lodge court applications relating to the recovery of costs associated with any services for which payment has not been made. In the event that you fail to make payment for services that you have engaged TJR Construction Adelaide to undertake, you agree to pay for costs associated with the following:
Fees associated to hiring a debt collector; and
Any fees associated to applications, hearings or other services provided by Courts SA to recover debts from your service; and
Any fees associated to outstanding payment charges; and
Any fees associated to legal representation for TJR Construction Adelaide.
Any fees associated with additional labour, material, machinery, etc, relating to the removal of structures or material
Service Provision:
At least 14 days notice must be provided in the event you wish to change a service type or cancel your appointment. In the event of any less notice being provided, charges may be incurred, services may not be able to be undertaken.
A service will be deemed to have been completed upon our staff leaving the property upon services having been completed, or upon advising you in person if you’re present at the property at the time after the service has been completed.
Utilisation of Contracted and Sub-Contracted Workers:
In addition to the use of staff employed directly by TJR Construction Adelaide, we may utilise the assistance of other contracted or sub-contracted personnel to complete services. These contractors are separate to TJR Construction Adelaide, and are not direct employees of the business. They may be required to hold their own public liability insurance, and their own equipment. All work undertaken by such contractors has oversight from TJR Construction Adelaide, and any deficiencies identified in works carried out will be remedied by TJR Construction Adelaide. To request any information relating to the use of contracted or sub-contracted personnel on any jobs undertaken by TJR Construction Adelaide, please contact us directly via the contact methods listed below.
TJR Construction Adelaide utilise the assistance of such contracted and sub-contracted personnel for the following purposes:
For the provision of expert trade practice or construction services
For additional labour or construction personnel to assist in completing jobs
As otherwise advised by TJR Construction Adelaide
You understand and agree to hold harmless TJR Construction Adelaide for any actions undertaken by contracted or sub-contracted staff separate to TJR Construction Adelaide which is negligent, inappropriate, or against construction guidelines or codes of practice. In the unlikely event of any such issues arising, TJR Construction Adelaide will work directly with you in taking action against such personnel, and will complete the services utilising other workers.
Evidence of Services Rendered:
As a part of our services you agree to permit our team to take photographs of areas in which services are to be or have been undertaken. You agree that TJR Construction Adelaide may retain these images for both record-keeping purposes, for use in marketing, and to supply evidence of services rendered for an indefinite period. Photographs will be taken at the discretion of TJR Construction Adelaide staff, and you agree that TJR Construction Adelaide are not obligated to photograph any aspects of services undertaken.
TJR Construction Adelaide will not take photographs of any sensitive materials, photographs of people, or other areas of significance that would normally be reasonably objected to.
TJR Construction Adelaide will consider any requests from any client that specifies in writing that they do not wish for photographs of areas in which cleaning has been undertaken at their property to be published online.
Reviews For Service:
Upon completion of services provided by TJR Construction Adelaide, we encourage you to provide us with accurate feedback relating to your experience of our services. This can be done through email, social media, google, and other formats as specified by TJR Construction Adelaide. You agree that all information published by you in respect to TJR Construction Adelaide will be accurate and factual, based on the services provided by TJR Construction Adelaide.
Furthermore, you agree to accept full accountability and liability for any comment or other information published by any means (written, verbalised, digital or other) which is proven to be inaccurate, dishonest, libellous or slanderous.
